Under certain personal circumstances the Therapies offered at Contrast Wellness may not be suitable to an individual’s personal requirements or compatible with their current prescribed medications or medical treatments. To ensure all our clients receive the best possible experience and personal outcomes it is vitally important that this mandatory form is read, fully understood, ticked as appropriate and signed before any treatments can be undertaken.
This agreement commences once you have indicated your acceptance in the Declaration section of this sign up process. If you did not sign up on the clubs premises you have 14 full days after signup to cancel this agreement for any reason. To exercise this right you must inform Contrast Wellness of this by post, email or telephone using the details available on our app, by agreeing to these terms you also agree to our other policies which are available upon request.
General
Booking sessions
· Bookings are only accepted from members whose membership fees are up to date/ valid drop-in sessions.
· Bookings can be made 2 weeks in advance.
· Attendance for your session must be registered upon arrival at the reception desk.
· Cancellation of a booking must be made no later than 2 hours before the booking is due to start. Any cancellations received within 2 hours of the start time will mean you may be charged and lose your credit.
· If you do not attend a booking, you will be charged.
· If you have an injury or illness that may affect your ability to participate, please make us aware.
· We reserve the right to restrict a member’s ability to pre-book classes if the member persistently fails to attend booked classes.
Membership
· Membership does not guarantee the availability of a parking space. Parking spaces are available on a first come first served basis.
· Members must always keep their personal details up to date. Any changes should be made via the members area in our booking system.
· Smoking (including e-cigarettes) is not permitted.
· We ask you to familiarise yourself with the contents of our signs, notices on display and the location of the emergency exits.
· You are required to abide by our policy on the use of cameras, video and mobile phones.
· Failure to adhere to these rules may result in the termination of your membership.
· Contrast Wellness retains the right to refuse entry to any individual.
Day Pass
· Day Passes are valid for entry for 24 hours, starting from the time of purchase.
· Day Pass users may only use the facilities during their allotted time.
· All other facility etiquette applies to Day Pass users.
· Contrast Wellness retains the right to refuse entry to any individual.
Cancelation
· 1 Month Minimum Contract on all rolling Direct Debits. Unless cancellations fall within the below terms.
· Relocation: This agreement can be cancelled in the event that your new permanent address is more than 15 miles away from the facility upon receipt of a copy utility bill or bank statement showing the new address.
· Long term (over 3 month) illness or injury: This agreement may be cancelled in the event of an illness, injury or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for 3 months or longer upon appropriate proof being provided.
· Redundancy: This agreement can be cancelled upon appropriate proof of redundancy from your employer or other loss of livelihood.
· Pregnancy: This agreement can be cancelled if you become pregnant upon the appropriate written proof being given. Please note – ANY Cancellation for the above reasons will not be effected until the appropriate proof is provided and received (in writing or via email)
· Breach: This agreement can be cancelled if we are in breach of contract including if we do not provide facilities or services you may reasonably expect and we have fallen well below that standard.
Freezing
· Temporary Illness or Injury: This agreement may be frozen in the event of a temporary illness, injury or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for a period of time.
Please note – ANY Freeze will not be effected until the appropriate proof is provided and received (in writing or via email).
Please note – A freeze period does not affect the Minimum No. of Direct Debit Payments you are due to make and any payments remaining at the time of the freeze will remain due and recommence on a monthly basis once the freeze period has completed.
General Terms
· You agree to comply with the Rules of Membership which are displayed prominently in the terms and conditions and relate to opening hours, use of facilities and your conduct. We may make reasonable changes to these Rules at any time provided we give you reasonable advance notice of the change.
· If we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date.
· We may assign the benefit of this agreement and our rights thereunder to a third party on notice to you. Your rights under this agreement will not be prejudiced.
· We will do our best to resolve any disputes over this agreement. If you wish to take court proceedings against us you must do so within the United Kingdom. Relevant UK law will apply.
· If any part of this agreement is disallowed or found to be ineffective by any court or regulator, the other provisions shall continue to apply.
· We may terminate this agreement with immediate effect on notice to you if you are in breach of Contrast Wellness LTD Rules (i.e. Stealing or other criminal activities within the facility). In this event you will not be liable to pay any further Direct Debit Payments, provided such breach is not deemed by us to have occurred primarily in order to qualify you for a refund.
Liability
· We do not accept liability for damage or loss to your property or a guest’s property that may happen UK Terms and Conditions December 2022 on the premises or within the grounds of Contrast Wellness, other than the liability which arises from our negligence or our failure to take reasonable care.
· We do not accept liability for the injury or death of any member, child or guest that may happen on the premises or within the grounds of Contrast Wellness other than the liability which arises from our negligence or our failure to take reasonable care.
· Nothing in these terms and conditions is meant to limit any rights you might have as a consumer.
Data protection
· We will deal with all information we hold about you in line with our privacy policy which you can request from us, if you want to know what information we hold about you, or you want us to correct any information we hold about you, the appropriate procedures are set out in our privacy policy.
Facilities
Use of the facilities:
SAUNA
The shower must be used, pre and post sauna session, especially if you are booked into a Contrast session and are in between the Sauna and Ice baths.
I am aware I may need to consult my GP practice and must inform Contrast Wellness staff if I have any concerns on the following.
The sauna must not be used if you are or think you might be pregnant.
Although published studies do indicate that the therapies offered by Contrast Wellness have both physical and mental health benefits as an addition to more traditional forms of medicine, Contrast Wellness does not claim our therapies are replacements for medication or any medical treatment of any kind. Only your personal doctor or other health professional can best advise you on matters relating to your health. During phases of any acute illness please take professional medical advice from your doctor before partaking in any therapies offered by Contrast Wellness
COMPRESSION RECOVERY BOOTS
Dynamic compression therapy is a massage-like treatment that uses compressed air and a pulsing massage pattern to squeeze and release the treatment area (legs, arms, or hips), effectively mimicking the muscle pump. It increases blood flow in the body and releases tension in the damaged or sore areas.
You should NOT do compression if you suffer from lung problems, such as acute pulmonary oedema or pulmonary embolism, congestive heart failure, deep vein thrombosis, thrombophlebitis, any acute infection, or have dislocated or fractured bones, wounds, or lesions on or near the treatment area.
Compression Recovery Boots shouldn’t be used if you have the following conditions:
ICE BATHS
I agree that, as the Participant:
· I will not use the facilities under the influence of alcohol or drugs (including any prescription drugs causing drowsiness or unconsciousness)
· I do not have any communicable or infectious skin condition, disorder or diseases, large cuts, open sores, or wounds.
· I will shower thoroughly before entering the ice bath, ensuring all oils, creams, or makeup is removed from my body.
· I do not have a kidney disease.
· I do not suffer from epilepsy or chronic heart disease or, if I do, my use of the ice bath has been approved by a doctor in writing.
· I am not pregnant, and I do not suffer from diabetes or low blood pressure, or my use of ice baths has been approved by a doctor.
· I do not have a condition, and I am not medicated in any manner, which may be adversely affected by cold water immersion.
· I will not use the ice bath if I have incontinence and will not voluntarily/involuntarily release bodily fluids of any kind while inside the ice bath.
· I have not:
a. had any chemical processing or permanent dye of my hair within the past 2 weeks;
b. had my hair subject to Keratin treatment in the last 4 weeks;
c. used any Henna products in the last 4 weeks;
d. used spray, lotion or any other fake tanning products in the past 7 days;
e. had any semi-permanent dyes used in my hair (must wait until fully washed out)
· I am not currently menstruating.
· I currently do not have hair extensions.
· I understand that shaving or waxing 24hrs before entering the ice bath can sting or irritate my skin.
· I am not currently cytotoxic and will not use the ice bath whilst undergoing any cytotoxic treatment (e.g. Chemotherapy). I will check with my medical consultant to see how long I must wait until I am no longer cytotoxic.
· I will use great caution while entering and exiting the ice bath and the entire time I am in the facility. I understand there is a risk of wet and slippery surfaces.
· I understand that the ice bath is not discarded/drained between each dip, but is filtered, sanitised, and recycled, and that our ice baths are inspected between every single dip.
I understand that if I breach the terms, or otherwise contaminate the water of the ice bath, I will be financially responsible for draining and replacing the water and special cleaning services (up to £500).
I HAVE READ, AGREED AND WILL ADHERE TO THESE TERMS AND CONDITIONS.
